to the information we collect when you or your computer interact with
our websites. By accessing any 95 Percent Group Inc. website (the
“Websites”), you acknowledge and fully understand 95 Percent Group
Inc.’s Privacy Statement and freely consent to the information
collection and use practices described in this Website Privacy
Statement. 95 Percent Group Inc. has the discretion to occasionally
update this Privacy Statement. All changes to this Privacy Statement
are effective upon posting to the Websites without notice to you. We
encourage you to periodically review this Privacy Statement to stay
informed about how we are helping to protect the personal information we
collect. Your continued use of the Website(s) constitutes your
agreement to this Privacy Statement and any updates or changes.
2. PARTICIPATING MERCHANTS AND THEIR POLICIES
Related services and offerings with links from this Website, including
vendor sites, have their own privacy statements that can be viewed by
clicking on the corresponding links within each respective Website. We
do not have direct control over the policies or practices of
participating merchants and other third parties; therefore, we are not
responsible for the privacy practices or contents of those sites and
this Privacy Statement does not apply to such third-party sites. These
other sites may send their own cookies to users to collect data or
solicit personally identifiable information. We recommend and encourage
that you always review the privacy policies of merchants and other third
parties before you provide any personal information or complete any

regarding data collection or privacy practices on the websites that are

95 Percent Group Inc. reserves the right to share aggregated site statistics with partner companies.
3. INFORMATION WE COLLECT AND HOW WE USE IT
95
Percent Group Inc. collects certain information from and about its
users three ways: directly from our Web Server logs, from the user, and
with Cookies.
a. Web Server Logs.
When
you visit our Website, we may track information to administer the site
and analyze its usage. Examples of information we may track include:
• Your Internet protocol address.
• The kind of browser or computer you use.
• Number of links you click within the site.
• State or country from which you accessed the site.
• Date and time of your visit.
• Name of your Internet service provider.
• Web page you linked to our site from.
• Pages you viewed on the site.
This
information allows us to better tailor our content to users' needs and
to help us and our partners better understand the demographics of our
audience.
b. Use of Cookies
95
Percent Group Inc. may use cookies to personalize or enhance your user
experience. A cookie is a small text file that is placed on your hard
disk by a Web page server. Cookies cannot be used to run programs or
deliver viruses to your computer. Cookies are uniquely assigned to you,
and can only be read by a Web Server in the domain that issued the
cookie to you.
One
of the primary purposes of cookies is to provide a convenience feature
to save you time. For example, if you personalize a web page, or
navigate within a site, a cookie helps the site to recall your specific
information on subsequent visits. Hence, this simplifies the process of
delivering relevant content and eases site navigation by providing and
saving your preferences and login information as well as providing
personalized functionality.
95
Percent Group Inc. reserves the right to share aggregated site
statistics with partner companies, but does not allow other companies to
place cookies on our Website unless there is a temporary, overriding
customer value.
You
have the ability to accept or decline cookies. Most Web browsers
automatically accept cookies, but you can usually modify your browser
setting to decline cookies. If you reject cookies by changing your
browser settings then be aware that this may disable some of the
functionality on our Website.
c. Personal Information Collected from Users
Visitors to our Websites can register to purchase or use services and
products. When you register, we will request some personal information
such as name, address, email address, telephone number or facsimile
number, account number and other relevant information. If you are
purchasing a service or product, we will request billing information,
which is used only to bill you for the services you purchase. If you
purchase by credit card, this information may be forwarded to your
credit card provider. For other types of registrations, we will ask for
other relevant information. You may also be asked to disclose personal
information to us so that we can provide assistance and information to
you. For example, such data may be warranted in order to provide online
technical support and troubleshooting.
We
will not disclose or sell personally identifiable information we
collect from you to third parties without your permission except to the
extent necessary including:
- To fulfill your service requests for services,
- To protect ourselves from liability,
- To respond to legal process or comply with law, court orders, or government regulations, or
- In connection with a merger, acquisition, or liquidation of our company.
In
addition, 95 Percent Group may gather additional information regarding
users using 95 Percent Group’s online training Websites. If the user is
part of an organization that has contracted with or purchased online
course access from 95 Percent Group, such as a school district or
school, user information will be made available to that organization as
well as to 95 Percent Group staff. Such information may include, but
not be limited to, usage statistics, course completion status, grades on
quizzes and course feedback. Such information regarding individual
users who have enrolled in 95 Percent Group Courses on their own, not as
part of an organization contracting services with 95 Percent Group,
will not be shared with any third party, except as statistics aggregated
with those of other users, with no individually identifiable
information.
95
Percent Group takes reasonable steps to protect your personally
identifiable information as you transmit your information from your
computer to our Websites and to protect such information from loss,
misuse, and unauthorized access, disclosure, alteration, or destruction.
You should keep in mind that no Internet transmission is ever 100%
secure or guaranteed error-free. In particular, e-mail sent to or from
the Websites may not be secure, and you should therefore take special
care in deciding what information you send to us. Moreover, where you
use passwords, user IDs, ID numbers, or other special access features on
this site, it is your responsibility to safeguard them.
For
any application that involves data related to school students, 95
Percent Group builds its student data applications with data security as
one of its key requirements, to comply with the Family Educational
Rights and Privacy Act (FERPA) and Illinois School Students Record Act
(ISSRA) . The applications are securely installed on our servers, and
access to these online applications are protected by our technical and
physical security infrastructure, personal login and password access, as
well as individual and record level security settings. Access to
student data is restricted by permission settings within each
application, so only the appropriate teacher, reading coach or school
administrator with an individual login and password can access to the
appropriate student information. Each school year, login credentials are
updated and access levels are confirmed to ensure proper student data
security.
d. Children
Consistent
with the Federal Children's Online Privacy Protection Act of 1998
(COPPA), we will never knowingly request personally identifiable
information from anyone under the age of 13 without requesting parental
consent.
e. Email Communication
Email
is an important and indispensable tool for 95 Percent Group’s
communication with its clients and customers. When using any of 95
Percent Group’s online services, products, materials, training courses
and other resources, users must accept email from us and an “opt-out” is
not available. Other uses of email are optional, such as receiving our
newsletter and announcements of new products. In such cases 95 Percent
Group offers an “opt-out” link to remove oneself from a mailing list.
In most cases, a user’s email address is his or her user name/ID for
logging in to 95 Percent Group’s systems.
4. USE OF WEB BEACONS OR GIF FILES
95
Percent Group’s Web pages may contain electronic images known as Web
beacons – sometimes also called single-pixel gifs – that allow 95
Percent Group Inc. to count users who have visited those pages and to
deliver co-branded services. 95 Percent Group Inc. may include Web
beacons in promotional e-mail messages or newsletters in order to
determine whether messages have been opened and acted upon.
Some
of these Web beacons may be placed by third party service providers to
help determine the effectiveness of our advertising campaigns or email
communications. These Web beacons may be used by these service
providers to place a persistent cookie on your computer. This allows
the service provider to recognize your computer each time you visit
certain pages or emails and compile anonymous information in relation to
those page views, which in turn enables us and our service providers to
learn which advertisements and emails bring you to our Website and how
you use the site. 95 Percent Group Inc. prohibits Web beacons from
being used to collect or access your personal information.
5. ACCESSING WEB ACCOUNT INFORMATION
On
any 95 Percent Group Website that has individual accounts, we will
provide you with the means to ensure that personally identifiable
information in your web account file is correct and current. You may
review this information by accessing the account online, if available,
or by contacting us by sending an email to our Support Team at
